Four Methods of Cancellations

  • The original Deed of Trust and original Promissory Note are submitted. Both must be marked “Paid and Satisfied” and must be Signed and dated by the beneficiary.
  • The Trustee shown on the Deed of Trust may personally appear in the Register’s office. The Trustee will make a marginal entry on the Register of Deeds’ copy of the Deed of Trust, indicating that the Deed of Trust has been canceled.
  • The Trustee or Substitute Trustee may submit a “Notice of Satisfaction”. The original copy of the Deed of Trust must accompany the “Notice of Satisfaction”.
  • The owner or holder of the note may sign and acknowledge a “Certificate of Satisfaction”. The certificate must be accompanied by the note (or “Affidavit of Lost Note” if the original note is lost) as well as the original or copy of the Note of Trust. The original note must be endorsed “Paid and Satisfied” by the owner of the note. If an “Affidavit of Lost Note” is submitted instead, the must be signed by the owner of the note and contain all the information required in G.S. 45-37(a)(6).
